Article 1. Purpose
These Terms set out the conditions and procedures for using the Service provided by the HamaHama operator (the "Operator"), the rights, obligations, and responsibilities of the Operator and users, and other necessary matters.
Article 2. Definitions
- "Service" means the HamaHama application and website provided by the Operator, and all related services, regardless of device type.
- "User" means a person who agrees to these Terms and the Privacy Policy and uses the Service.
- "Account" means the user ID chosen by the user and the information linking it to a social login account (Kakao, Google, or Apple) to identify the user.
- "Study measurement" means the feature that uses camera images to determine whether the user is studying and records only time during which the user is determined to be studying.
- "Study time" means the accumulated time determined to have been spent studying through study measurement.
- "Study Together" means the feature that lets users study in video rooms while sharing live video and audio of themselves studying through their cameras and microphones.
- "Group" means a group that users create or join to share study time rankings and study activity.
- "Study timelapse" means the feature that compiles images captured during study into a video on the user's device.
Article 3. Publication and Amendment of These Terms
- The Operator publishes these Terms and the Privacy Policy on the Service's website (studyhama.com/terms) and on linked screens within the app so that users may access them at any time.
- The Operator may amend these Terms to the extent permitted by applicable laws. When amending the Terms, the Operator announces the changes and effective date using the methods in paragraph 1 at least 7 days before the effective date. Changes unfavorable to users are announced at least 30 days in advance.
- Users have the right not to agree to amended Terms and may stop using the Service and delete their accounts if they disagree. If the notice in paragraph 2 also states that a failure to express a position by the effective date will be treated as agreement, a user who does not express disagreement before that date and continues to use the Service is deemed to have agreed to the amended Terms.
- Matters not addressed in these Terms are governed by applicable laws and operating policies separately established and announced by the Operator.
Article 4. Formation of the Service Agreement and Age Requirements
- The service agreement is formed when the user agrees to these Terms and the Privacy Policy, creates an account through social login, and the Operator accepts the registration.
- Anyone under 14 may not register for or use the Service without the consent of a legal representative. By agreeing to these Terms at registration, users confirm that they are at least 14 or, if under 14, that they have obtained the consent of a legal representative. The legal representative of a user under 14 may request that use of the account be stopped and its personal information deleted at any time.
- The Operator may refuse registration or subsequently terminate the service agreement in the following cases:
- The applicant uses another person's account or identity without authorization, or provides false information.
- One person creates two or more accounts and disrupts the Service, for example by inflating study time or rankings.
- A person previously permanently banned for violating these Terms registers again.
- The applicant intends to use the Service to violate the law.
- Users may not choose a user ID or nickname that impersonates another person or the Operator, or includes profanity, hate speech, or sexual expressions. The Operator may require such a nickname to be changed or change it directly.
Article 5. Account Management
- Users are responsible for managing their accounts. They may not allow third parties to use their accounts, or transfer, lend, rent out, buy, or sell accounts.
- The Operator is not liable for losses arising from a user's failure to manage their account properly or from allowing a third party to use it, unless the Operator acted intentionally or with gross negligence.
- If a user learns that their account has been used without authorization, they must notify the Operator immediately and follow the instructions provided.
Article 6. Service Features and Fees
- The Operator provides the following services:
- Study measurement and recording of study time and statistics (solo study)
- Study Together, groups, and rankings
- Creating, saving, and sharing study timelapse videos
- Study and group notifications
- Other features added by the Operator
- The Service is provided free of charge. If paid services are introduced, the Operator will announce their features, fees, payment terms, and conditions for withdrawal from the purchase in advance, and establish separate terms where necessary.
- Users bear the cost of devices, telecommunications, and data required to use the Service. Features that use the camera may consume substantial battery power depending on device specifications and usage conditions.
Article 7. Nature and Limitations of Study Time Measurement
- Study measurement automatically examines captured images. Automated checks cannot be perfect, so the Service may determine that a user is not studying when they actually are, or produce the opposite result. The Operator does not guarantee absolute accuracy of the results.
- If the user is determined not to be studying, the ongoing study record may be ended or study time may be adjusted. This is an intended function of the Service to maintain the reliability of records. Users who believe an error has occurred may request a correction through [Settings > Contact us].
- Results may vary depending on camera performance, lighting, posture, obstructions, and other capture conditions. Study measurement does not function without camera permission or when images cannot be captured.
- Users must not distort measurement results through improper methods that make them appear to be studying when they are not. If such conduct is confirmed, records may be deleted and use restricted under Article 10.
- Study time and statistics are records for reference in studying. The Operator does not guarantee grades, exam results, or learning achievements based on them. Users are responsible for the consequences of using Service records for external purposes, such as evidence of academic performance, work attendance, or school attendance.
- The Operator may change the measurement method to improve measurement quality and Service stability. Changes that materially affect how users' records are calculated will be announced in advance.
Article 8. Study Together: Camera Rules
Study Together lets users study while viewing one another's camera feeds in real time. Because this feature transmits users' images to others, users must follow these rules.
- The following conduct is prohibited:
- Transmitting bodily exposure, sexual acts or expressions, or other images or sounds that cause sexual humiliation or disgust, or displaying such content in the camera view
- Photographing, recording, or capturing other users' video, audio, or screens, or storing, transmitting, posting, or distributing them
- Using information obtained from another user's face or surroundings to identify them, or collecting, storing, or disclosing such information
- Harassing other users through profanity, insults, discriminatory or hateful expressions, or threats conveyed by audio, content shown on camera, nicknames, or similar means
- Sending sexual or violent content to minors, or encouraging private meetings with minors
- Using video rooms for purposes other than studying, including advertising, promotion, business solicitation, political activities, religious proselytizing, or encouraging gambling
- Broadcasting or relaying video room screens to external platforms without the Operator's consent
- Transmitting illegal content, or encouraging or planning crimes
- When joining a video room, users are responsible for checking what is visible in their camera view. They must take care not to include information they do not wish to disclose, such as identification documents, addresses, school names, or other people's faces.
- The Operator does not record or store video or audio and cannot completely prevent other users from capturing the screen with their own devices. Such conduct is prohibited under paragraph 1 and is subject to action under Article 10 when reported. Depending on the circumstances, it may also be subject to criminal penalties under the Act on Promotion of Information and Communications Network Utilization and Information Protection, the Act on Special Cases Concerning the Punishment of Sexual Crimes, the Act on the Protection of Children and Youth Against Sexual Abuse where the other person is a child or adolescent, or provisions on defamation, intimidation, and other offenses under the Criminal Act.
- Users may use only the solo study feature without using Study Together.
Article 9. General User Obligations and Prohibited Conduct
In addition to the rules in Article 8, users must not:
- Manipulate Service records, including study time, rankings, or statistics, through improper methods
- Create multiple accounts to distort group rankings or statistics
- Access the Service in ways outside normal use or place an excessive burden on its operation
- Modify the app or bypass security measures to use the Service
- Impersonate the Operator or other users
- Copy, distribute, or commercially use information obtained through the Service without the Operator's prior approval
- Infringe the Operator's intellectual property rights, including trademarks, designs, screens, and text
- Otherwise violate laws, these Terms, or operating policies, or interfere with normal operation of the Service
Article 10. Reports and Restrictions on Use
- Users may report another user's violations through [Settings > Contact us]. After receiving a report, the Operator reviews the facts and takes necessary action.
- The Operator may take the following measures, considering the nature, severity, and recurrence of the violation:
Type of violation Action Bodily exposure or sexual conduct; sexual conduct targeting minors; capturing or distributing other users' video Immediate suspension on the first violation, followed by a final decision on a permanent ban after the opportunity to respond under paragraph 3. Suspected violations of law are reported to investigative authorities. Profanity, hate speech, or harassment through audio, video, or nicknames; use of video rooms for advertising or business solicitation First violation: 3-day suspension; second: 30-day suspension; third: permanent ban Distorting measurement results; manipulating records or rankings; using multiple accounts Deletion of improper records, plus a 7-day suspension for the first violation and a permanent ban for the second Other violations of the Terms A warning and request to correct the violation, followed by temporary or permanent restrictions if it is not corrected - The Operator gives users an opportunity to explain their position before taking action. However, if harm to other users may continue or increase, the Operator may suspend use first and then provide an opportunity to respond.
- Users who disagree with an action may object through [Settings > Contact us] or email. Within 15 days of receiving the objection, the Operator notifies the user of the review result and its reasons. If the objection is found to be justified, the action is lifted immediately. Users may seek dispute mediation or bring legal proceedings independently of this process.
- Once a permanent ban (termination of the service agreement) is finalized, the account's study records and group participation information cannot be restored. However, statutory rights, including access to and deletion of personal information, remain available regardless of restrictions on use. Requests may be submitted using the contact details in Article 20.
Article 11. Rights and Responsibilities for Study Records and Timelapse
- Users hold the rights to materials generated through their study activities, including study records, statistics, and timelapse videos. The Operator uses them only to the extent necessary to provide the Service.
- The Operator does not collect or retain users' timelapse videos, or use them for other purposes such as promotion or advertising.
- Users who save, share, or post timelapse videos or study record screens externally are responsible for the consequences and any resulting disputes. Users should take care not to disclose images containing other people's faces without consent.
- Materials stored only on a device may be lost due to a device change, app deletion, insufficient storage, or similar circumstances. The Operator cannot restore them.
Article 12. Service Availability, Changes, and Interruptions
- In principle, the Service is available 24 hours a day, every day of the year.
- The Operator may temporarily suspend all or part of the Service for operational or technical needs, including maintenance, equipment replacement, feature additions, or incident resolution. Advance notice will be given, but in urgent circumstances notice may be given afterward.
- The Operator may change the Service's content, features, or structure, or discontinue certain features. Changes that materially affect the calculation of users' records or major features will be announced in advance.
- The Operator may provide app updates for stability and security and may require use of the latest version to ensure smooth delivery of the Service.
- The Operator is not liable when the Service cannot be provided due to causes beyond its control, including natural disasters, power outages, communication failures, or sudden increases in usage that could not reasonably have been anticipated, unless the Operator acted intentionally or with gross negligence.
- If the Operator discontinues the entire Service, it will announce the closure through in-app notices and the website at least 30 days before the closure date and allow a period for users to review and retain their records.
Article 13. Advertising
- The Operator may display advertisements within the Service as necessary for its operation. Users agree to the display of advertisements encountered while using the Service.
- If the Operator sends advertising messages through app notifications or email, it obtains separate prior consent under Article 50 of the Act on Promotion of Information and Communications Network Utilization and Information Protection. Separate consent for nighttime messages is obtained for messages sent between 9 p.m. and 8 a.m. the following day. Consent may be withdrawn at any time.
- In-app advertisements are the same for all users. The Operator does not collect advertising identifiers or operate personalized advertising that tracks users. Website advertising performance measurement is governed by Article 10 of the Privacy Policy.
- The results of a user's communications or transactions with a third party through an advertisement are matters between that user and the third party. The Operator is not liable for resulting losses unless it acted intentionally or with gross negligence.
Article 14. Intellectual Property
- The Operator owns the intellectual property rights in the Service and app, screen layouts, trademarks, text, images, and related materials.
- Without the Operator's prior approval, users may not use the materials in paragraph 1, or allow third parties to use them, by copying, distributing, transmitting, publishing, displaying, creating derivative works, or similar means.
Article 15. Protection of Personal Information
- The Operator protects users' personal information in accordance with applicable laws. Processing of personal information is governed by the Privacy Policy.
- The Operator's Privacy Policy does not apply to third-party services that are merely linked from the Service.
Article 16. Termination and Account Deletion
- Users may terminate the service agreement at any time through [Settings > Delete account].
- When an account is deleted, account information, study records, and group participation information are deleted without delay and cannot be restored.
- Groups created by a user are deleted when that user's account is deleted. The groups and participation information also disappear for other participants. To keep a group going, please arrange for another participant to create a group before deleting your account.
- The Operator may terminate the service agreement under Article 10 if the user materially violates these Terms.
Article 17. Scope of Liability and Disclaimers
- The Operator strives to comply with these Terms and applicable laws and to provide the Service reliably.
- The Operator is not liable for losses arising from the following causes, unless it acted intentionally or with gross negligence:
- Errors in automated checks under Article 7 or resulting differences in study time records
- Measurement interruptions caused by device performance, settings, or usage conditions
- Features failing to operate because the user has not granted camera or notification permission
- Harm caused by other users' violations (the Operator takes action under Article 10 when a report is received)
- Harm arising from records or videos that users themselves save, share, or post externally
- Causes beyond the Operator's control, including natural disasters and communication or power failures
- If a user causes harm to the Operator or a third party by violating these Terms, the user is responsible for compensating for that harm.
Article 18. Notices
The Operator provides notices through one or more of the following: in-app announcements, notifications, website posts, or the user's registered email address. Notices to all users may be provided through in-app announcements or website posts instead of individual notices. However, matters that materially affect individual users' rights, such as restrictions on use, termination of the service agreement, or amendments unfavorable to users, are communicated individually through in-app notifications or the user's registered email address.
Article 19. Dispute Resolution and Jurisdiction
- If a dispute arises concerning use of the Service, the Operator and the user will consult in good faith to seek an amicable resolution.
- If an agreement cannot be reached, the dispute is governed by the laws of the Republic of Korea, and proceedings may be brought before a court with jurisdiction under the Civil Procedure Act.
- Users may seek mediation from the Content Dispute Resolution Committee (www.kcdrc.kr) for content-related disputes, the Personal Information Dispute Mediation Committee (1833-6972) for privacy disputes, or the Consumer Dispute Settlement Commission of the Korea Consumer Agency (1372, www.kca.go.kr) for other consumer disputes.
